Davis Demographics values the privacy of those who visit our website, request information, and register for our software and services.

We think it is important to you to understand when and why we collect personally identifiable information and how we may use it.  This Privacy Statement describes our data collection and use policies.  Please read the entire Privacy Statement before providing any personally identifiable information (PII) to us.

We collect PII such as your name, address, telephone number and/or email address, only if you provide this information to us voluntarily.  The voluntary information we collect is used internally to complete business transactions between you and our firm, provide notifications to our software clients about updates to our software, training opportunities and conferences, provide technical and product support to our users, and send newsletters and other communications we feel will be of benefit to clients and web site visitors.  Where appropriate to provide additional software support, we pass this data to our Business Partner, Esri, who also provides certain components of our software offerings.  Esri is also committed to protecting personally identifiable information as described in their privacy statements/polices at www.esri.com.

Certain information about your computer may be collected using “cookies” to enhance your web site viewing experience.  We do not use cookies to store information such as credit card numbers or other information you provide.

We collect PII you provide to us when you order and register our software, register for training or conferences, or make requests that require a direct response to you.

Other than as described in this Privacy Statement, we will not disclose, share, or sell your PII unless required to do so by law or in good faith belief that such action is necessary to (1) conform to the edicts of the law, (2) protect and defend the rights or property of our firm, or (3) as part of a transfer of assets to a successor firm.

If you no longer wish to receive email or postal notifications from us, please let us know by sending an email to info@davisdemographics.com.  Please provide us with your exact name and address or email address as well as a description of the publication or email you received.  We will use all reasonable efforts to refrain from including you in these future notifications.

 

Providing Consulting Services

 

We also value the trust you provide in us during our consulting services engagements.  In providing such services, we adhere to all best practices in maintaining all data you provide to us in strictest confidence.  We include the follow language about PII in all service agreements:

All communication and information obtained by DAVIS from the DISTRICT relating to this Agreement and all information developed by DAVIS under this Agreement are confidential.  Should there be a need for DAVIS to maintain on its server(s) and/or other data storage media, personnel and/or student information protected by the Family Educational Rights and Privacy Act Regulations 34 CFR Part 99 (FERPA), DAVIS will take appropriate measures to ensure the security of said information and maintain its confidentiality according to applicable regulations.  In addition, DAVIS acknowledges and agrees that, in the course of its Agreement with the DISTRICT, DAVIS will receive or have access to personal information.  Personal information means information provided to DAVIS or to which access was provided to DAVIS by or at the direction of the DISTRICT in the course of DAVIS’ performance under this Agreement that (a) identifies or can be used to identify an individual, including without limitation, names, addresses, or other unique identifiers or (b) can be used to authenticate an individual, including, without limitation identification numbers or other sensitive information.  DAVIS shall comply with this Agreement in its collection, receipt, transmission, storage, disposal, use and disclosure of personal information under its control or in its possession and shall remain liable to the DISTRICT and to any other person whose personal information is under its control or in its possession.  In recognition of the foregoing, DAVIS agrees and covenants that it shall:  (a) keep and maintain all personal information in strict confidence using such degree of care as is appropriate to avoid unauthorized access use or disclosure, including but limited to security or data breach, malware intrusion or any other unauthorized  access to such personal information; (b) shall not use, sell, rent, transfer or otherwise disclose or make available personal information for the benefit of anyone other than the DISTRICT; and (c) at a minimum, DAVIS shall have in place safeguards for the protection of personal information which shall include limiting access to the DISTRICT information, securing business facilities, data centers, servers, back-up systems and computing equipment with information storage capability, as well as implementing network, database and platform security on computing equipment that are either owned by, used by or in the care or control of DAVIS.

At the end of any consulting engagement where we have collected personally identifiable data, we will securely store such data for a period of five years to accommodate any potential client requested follow-up.  After five years, or earlier if requested in writing by the client, we will delete all client provided data in accordance with industry best practices.
